New Hampshire legislators want to license all dog breeders

In January, a New Hampshire lawmaker introduced HB 216, a bill to require permits to own a Rottweiler, a Doberman Pinscher, or a pit bull. This month, two legislators introduced HB 438, a bill to test, license, and inspect breeders; close pet stores; and prohibit the importation of dogs and cats for resale.

Elin Phinizy of the Dog Owners of the Granite State reported that the bill requires a breeder to take and pass a breed-specific exam prepared by the American Kennel Club or licensed veterinarians and administered by a licensed veterinarian. The bill sets the license fee at $75 for two years and subjects licensed breeders to state inspection at least every six months.


The bill's flaws

1. Once again, it will be the responsible breeders who will be affected.

2. This definition of breeder, which does not discriminate between commercial and hobby breeding, would replace or supercede the current law that characterizes a commercial breeder and could easily bring many breeders in conflict with local zoning laws.

3. NH already requires a health certificate to accompany every dog or cat sold. This certificate requires that the animal be healthy and free of standard infestations, which this legislation ignores.

4. The irresponsible owners who have accidental breedings or people who merely raise a litter so the kids can see the miracle of birth or Fluffy can be fulfilled before she is spayed will not bother to get a license. The State Vet does not have the resources to enforce this provision of bill let alone police properly established pet shops or commercial establishments, which is already required by law.

The hearing on this bill to require permits to own Rotties, Dobes, and pit bulls was held on January 31, and the committee voted 13-0 to send the bill to the House floor with a recommendation that it is "inexpedient to legislate."
